Can anyone tell me what kind of flies are on my plants?

Hi there—the last few days I’ve been spotting all these flies (they kind of look like gnats or even mosquitoes?) all over my garden beds, in particular on my tomatoes and in the soil. Every time i water my plants or even just touch them, they all fly up. I managed to get two pictures of what they look like. Also I think something is eating my calendula that I have in the same garden beds, can anyone tell me what this is and how i can get rid of them? Appreciate all the help.
